Terms of use of the Swiadkuj app

Version of 22 October 2026 · Effective from 5 November 2026. Until 4 November 2026 the version of 18 October 2026 applies, which differs only in the definitions of Event and Guest of honor (§ 2).

This is an English translation provided for convenience. The Polish version (Regulamin) is the binding one; in case of any discrepancy, the Polish text prevails.

§ 1. General provisions

  1. These terms set out the rules for using the Swiadkuj mobile app (iPhone and Android) and the swiadkuj.pl website.
  2. The terms are made available free of charge on the swiadkuj.pl/regulamin website and in the app (Profile → Terms), before the contract is concluded, in a form that allows them to be downloaded, saved and printed.
  3. All services described in these terms are free of charge. The app does not display ads, has no in-app purchases and does not sell products.
  4. The processing of personal data is described in the Privacy policy.

§ 2. Definitions

§ 3. Services

The Service Provider provides the following services electronically:

  1. Events and invitations — creating an Event, inviting friends with a code or link, Surprise mode.
  2. Chat — the group channel and a shared channel with the Guest of honor, pinning and deleting messages.
  3. Polls — voting on the date, place or activities.
  4. Cost splitting — recording expenses, splitting costs and calculating who owes whom how much (§ 7).
  5. Location (“Find”) — voluntary sharing of position with selected people for a chosen time (§ 8).
  6. Safety — reporting messages, blocking Users, deleting the Account.

§ 4. Technical requirements

To use the App you need: an iPhone with iOS 15 or later or a phone with Android (the minimum version is given in the store and on the download page), internet access, and for the “Find” feature — permission to access location in the phone's settings.

§ 5. Account and age

  1. The contract for using the App is concluded when the profile is saved (entering a name, confirming being an adult and accepting the terms), for an indefinite period.
  2. The App may be used only by people who are at least 18 years old. By confirming that they are an adult, the User declares that this is true. The Service Provider deletes the Account of a minor.
  3. The Account is tied to the phone. Removing the App or changing phones may mean losing access to the Account — the App currently has no sign-in that would allow it to be recovered.
  4. The Service Provider takes care of the security and continuity of data, but a failure of a technical provider cannot be ruled out. It is worth keeping important arrangements outside the App as well.

§ 6. Rules of use — zero tolerance for offensive content

  1. There is no place in the App for offensive content or abuse. It is forbidden to publish in the chat, polls, names and descriptions:
    • hate speech, threats, harassment and intimidation,
    • pornographic content, and in particular any sexual content involving minors,
    • content inciting violence, self-harm or breaking the law,
    • spam, scams and other people's personal data without consent — including disclosing other people's location.
  2. Activities that disrupt the operation of the App are forbidden, in particular guessing invitation codes, sending automated requests, circumventing limits and safeguards, and attempts to access other people's data, including content hidden by Surprise mode.
  3. Slurs from the Service Provider's list are automatically masked with asterisks in the chat.
  4. Breaking the rules may result in removal of Content, removal from an Event and blocking or deletion of the Account (§ 11).
  5. Content remains the property of the User, who is responsible for it. The User authorizes the Service Provider only to store it and display it to the members of the given Event — to the extent necessary to provide the services. Content is visible only to Event members, subject to the limits of Surprise mode; the App does not publish it outside the Event.
  6. The texts, graphics and the Swiadkuj mark are protected by copyright. They may be used within permitted personal use; any other use requires the Service Provider's consent.

§ 7. Cost splitting — important disclaimer

  1. The App does not handle payments. It helps calculate who owes whom how much; repayments take place outside the App, between Users.
  2. Amounts are entered by Users. The Service Provider does not verify them and is not a party to settlements between Users.

§ 8. Location

  1. Location sharing is voluntary; the User turns it on themselves for a chosen time (24 hours at most) and can stop it at any time.
  2. The position may be inaccurate or delayed (signal coverage, phone settings, battery saving). The “Find” feature is not intended for saving life or health — in an emergency, call the emergency number 112.
  3. The map is displayed using OpenFreeMap tiles (data © OpenStreetMap); its availability is not guaranteed.

§ 9. Liability and availability

  1. The Service Provider makes efforts to ensure that the App works correctly and without interruption, but — since the services are free of charge — does not guarantee their continuous availability. Technical breaks, provider outages, changes and discontinuation of features are possible.
  2. The Service Provider is liable for damage caused to the User intentionally or through gross negligence. Liability for personal injury (life, health) is not limited in any way.
  3. The participants of an event, not the Service Provider, are responsible for how the event goes, including alcohol consumption and the safety of participants.

§ 10. Reporting content, blocking and contact (Digital Services Act)

  1. Any message can be reported in the App (press and hold the message → Report, choosing a reason), and its author can be blocked (Block) — their messages will no longer be visible to the blocking User. The User manages the block list in Profile.
  2. The Service Provider reviews reports from the App within 24 hours at the latest: it removes content that breaks the rules and may take the actions set out in § 11 against the person who published it. The Organizer can delete messages in their Event.
  3. The point of contact for Users and for the authorities of EU Member States, the European Commission and the European Board for Digital Services is [email protected]. You can write in Polish or English.
  4. Anyone can also report by email content they consider illegal. The report should contain: an explanation of why the content is illegal, an indication of where it is (Event, author, time), the name and surname or name and the email address of the reporting person (not applicable to reports of certain offences against children) and a statement that the report is accurate to the best of the reporting person's knowledge.
  5. The Service Provider handles reports without undue delay, objectively and diligently. It does not review Content on its own initiative; only the slur filter works automatically (§ 6(3)).
  6. If the Service Provider removes Content or blocks or deletes an Account, it will give the User a statement of reasons (what it did, on what basis and what facts led to the decision) — in the App or by email, if it knows the address. The User can reply to [email protected] and ask for the matter to be reconsidered; they may also pursue their rights in court.
  7. The Service Provider promptly notifies the competent law enforcement authorities of information indicating a criminal offence threatening the life or safety of persons.

§ 11. Termination of the contract and Account deletion

  1. The User may terminate the contract at any time, without giving a reason, by deleting the Account in the App: Profile → Delete account. Deletion is immediate and irreversible. You can also write to [email protected] — the Account will then be deleted within 30 days (details).
  2. After the Account is deleted, the content of the User's messages is deleted, and expenses, repayments and votes in other people's Events remain without a name, as “Deleted user”, so that other people's balances and results do not change. The User's Events are taken over by another person from the group, and if there is no one — they are deleted.
  3. The Service Provider may block or delete the Account of a User who breaches § 6 — for serious breaches (e.g. threats, sexual content involving minors, harassment) immediately, in other cases after an unsuccessful request to stop the breaches, if it can be delivered. Statement of reasons — § 10(6).
  4. The Service Provider may stop providing the services altogether, announcing this at least 30 days in advance in the App (a message or the update description in the store) and on the swiadkuj.pl website.

§ 12. Changes to the terms

  1. The Service Provider may change the terms for important reasons: changes in the law, a court ruling or a decision of an authority, changes to or addition of App features, a change of technical providers or security considerations.
  2. Users will be informed of a change at least 14 days before it takes effect — in the App (a message or the update description in the store) and on the swiadkuj.pl website. Accounts have no email address, so the Service Provider does not send email notifications. A User who does not accept the changes may delete the Account during this time (§ 11). Changes are not retroactive.

§ 13. Complaints

  1. Complaints about how the App works can be submitted by email to [email protected].
  2. A complaint should contain a description of the problem (what, when, on which phone and in which version of the App); we send the reply to the email address the complaint came from.
  3. The Service Provider responds to a complaint within 14 days of receiving it.

§ 14. Governing law and disputes

  1. Contracts concluded under these terms are governed by Polish law, in particular the Civil Code. The choice of law does not deprive a consumer of the protection afforded by the mandatory provisions of the country of their habitual residence.
  2. Disputes will first be resolved amicably, by email.
  3. A User who is a consumer may use the free assistance of a district (municipal) consumer ombudsman or consumer organizations. Regardless of this, they may bring the matter before the competent court.

§ 15. Final provisions

The terms are effective from the date indicated at the beginning of the document. The terms of the store from which the App was downloaded (App Store, Google Play) bind the User in their relationship with the store and do not change these terms. The Service Provider makes previous versions available on request by email.
